Any government agency, whether local, county, state, or federal, is required to maintain ADA compliance. Although the MUTCD does permit some variations for additional visibility, the basic specifications call for solid white lines not less than 150 mm (6 in) marking both edges of the crosswalk and spaced at least 1.830 m (72 in) apart (US DOT, 1988) (Figure 4-41). An inspection, performed by a Certified Access Specialist, is intended to protect against unwarranted lawsuits and: California legislators have also implemented tax benefits for small businesses, which can receive a tax credit of up to $5,000 to pay for inspection and construction costs. This problem is compounded by the fact that "pedestrians may 'feel safer' within a marked crosswalk and expect motorists to act more cautiously" (Institute of Transportation Engineers, Technical Council Committee 5A-5, 1998). They must be firm, stable and non slippery. Sidewalks may also not have any grate openings larger than half an inch across in order to prevent mobility devices from getting stuck. Any HOA allowing activities such as those outlined above should ensure ADA compliance by carefully inspecting the property to ensure that barriers (such as curbs), safety hazards, stairs/steps, etc. Under Senate Bill 1608, they can have facilities inspected for access compliance.
